General Conditions of Sale

These general conditions of sale (hereinafter “GCS”) govern the contractual relationship between LIKENG KELYE (hereinafter “the Supplier”) and the customer who places an order (hereinafter “the Customer”) on the website https://eshop.likengkelye.com (hereinafter “the Site”). They form an integral part of the contract between the Supplier and the Customer.

By placing an order on the Site, the Customer expressly confirms having read, understood and accepted the GCS without reservation.

The Supplier reserves the right to modify the GCS at any time and without notice. The version published on the Site at the time of the order is authentic. In the event of any discrepancy between the GCS and any specific indications on the order confirmation, the latter shall prevail.

 

ORDER

To place an order, the Customer must follow the instructions published on the Site. When the order is confirmed, the Customer makes a firm and definitive offer to purchase the selected products under the conditions indicated. Confirmed orders cannot be modified or cancelled.

 

PAYMENT TERMS & RATES

Payment methods: Direct bank transfer, Postfinance e-finance, PostCard, MasterCard, Visa.

The Products are supplied at the current prices appearing on the website “https://eshop.likengkelye.com”, when the order is registered by the Seller.

Prices are expressed in CHF including tax.

The price mentioned on the site is understood to include all taxes. It includes in particular the VAT applicable at the rate in force on the day of the order, excise duties and all other applicable taxes.

The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.


WARRANTY AGAINST DEFECTS

The Supplier formally undertakes to produce its products in compliance with the health procedures and standards established by the competent authorities.

All of the products available on the Site are free of any modified chemical preservative. In rare cases, this may result in a storage defect. In the event of a problem related to an order, the Customer must contact the Supplier within 48 hours from the date of receipt of the order. Within this period, the Customer must send a photo of the defective product to the Supplier, otherwise the defect is considered accepted. An exchange is only possible under the aforementioned conditions.

In order to avoid any alteration in the quality and freshness of the Supplier’s products. Carefully follow the instructions on the labels and remember to use clean utensils to avoid the proliferation of bacteria.


DURATION OF THE PROCESSING OF YOUR ORDERS

Once the order has been placed, you will receive a summary of your order as well as a second email informing you that the Supplier has taken charge of it. As the

Supplier undertakes to make 100% artisanal products, the stocks available at the time of the order are not necessarily sufficient. Nevertheless, the Supplier undertakes to deliver the order within a maximum period of 7 working days from the date of confirmation of the order.


DELIVERY

The delivery of your order is made by post, to the address indicated by the Customer on the order confirmation. The Customer is solely responsible for the accuracy of the address provided.

Shipping and packaging costs of 5,95 CHF (Swiss francs) are invoiced in addition for any order less than 240.- CHF (Swiss francs). The shipping costs related to any order of an amount exceeding 240.- CHF are borne by the Supplier.

Orders are sent by B mail. In principle, they are delivered within two working days following the date of dispatch of the package. The Supplier declines all responsibility in connection with a delay by the Post Office.

In derogation from the above, delivery is free of charge for the Customer, provided that the delivery address is located within the districts of the city of Zürich.

 

RETURN RIGHTS

There is no general right of return on products free of defects and correctly delivered.

On the other hand, no right of return can be granted in the following cases:

• damaged products (with the exception of transport damage);
• products that cannot be returned in their original packaging;
• open products;
• products whose intrinsic quality (eg in terms of taste) does not meet the customer’s requirements.


Refund

LIKENG KELYE undertakes to deliver paid orders on time and within the limits of available stocks. If, for whatever reason, LIKENG KELYE cannot make the delivery, it undertakes to reimburse the customer for the amount he has paid. There is no obligation for compensation in kind. Any liability for damages is excluded.


Return fees

Postage costs for returning items are generally the responsibility of the sender. In the following cases, the return costs are covered by LIKENG KELYE:

• upon receipt of a product different from that ordered;
• upon receipt of an unordered product;
• in the event of incorrect data in the online store.


DATA PROTECTION

All personal data will be considered confidential. The information necessary for the management of the order will be subject to computer processing and may be communicated to associated companies as part of the management of the order.
